Before You Fill Out Form 941

The fastest way to file Form 941 is through the federal e-File system. Business taxpayers can access e-File through most tax preparation software for small businesses. Who has to file Form 941

If you operate a business and have employees working for you, then you likely need to file IRS Form 941, Employer’s Quarterly Federal Tax Return, four times per year. As an employer, you are responsible for withholding federal income tax and other payroll taxes from each employee’s paycheck and remitting it to the IRS. Each Form 941 you file reports the total amount of tax you withheld from employees’ pay during the quarter as well as the employer’s share of payroll taxes. Form 944 is designed for employers with an annual employment tax liability of $1,000 or less. Form 944 generally is due on January 31 of the following year.

Filing a Form 941 with an incorrect EIN or using another business’s EIN may result in penalties and delays in processing your return. After you file your first Form 941, you must file a return for each quarter, even if you have no taxes to report, unless you filed a final return or one of the exceptions listed next applies. Use the March 2024 revision of Form 941 to report taxes for the first quarter of 2024; don’t use an earlier revision to report taxes for 2024.
